Significant Changes – Removal of the Labour Market Testing Requirement

We are pleased to announce that labour market testing is now no longer a requirement for certification under the RSMS.  The first of the significant changes to the RSMS came into operation from September 2011, when Perth was deemed to be ‘regional’ for migration purposes.

Prior to the most recent change, employers were required to show that the visa applicant had been working in the nominated occupation for at least two years or complete labour market testing by showing that the occupation nominated had been advertised in print media for a period of at least 3 months, even where the position was currently filled with a subclass 457 visa holder.  In short, it was a complex system and difficult to access the benefits.

The removal of labour market testing will provide substantial benefits to employers who employ staff in the Perth, the Pilbara and the Wheatbelt regions, and has significant potential to partially address skills shortages.
